Terms

These are the terms for using nodes and for buying nodes plus. They are written to be read. The Polish version, Regulamin, says the same thing. If you live in Poland, the Polish version is the binding one.

The short version

Who provides nodes

nodes is made and run by Belgutei Tsevegmed, a private person in Poland, not a registered company. In these terms, "we" means that person. Contact: privacy@nodes.cards. That address takes questions, complaints and requests about your data. A postal address is available on request at the same address.

What nodes is

nodes is a flashcard app with a spaced-repetition scheduler. It runs on macOS and Windows, and in a web browser at /app/. It is in beta: features change, and some will break before they are finished. To use it you need an account with an email address. Sync and the AI features also need an internet connection.

You must be at least 16 to create an account. That is the age at which Polish law lets you agree to the data processing described in the privacy page yourself.

Your cards and what you may put in them

You keep every right you have to what you write or import. You give us only the permission we need to store your cards, sync them between your devices and show them back to you. We do not sell them, publish them or use them to train anything.

Do not use nodes to store or spread anything illegal. That includes content you have no right to copy, such as a commercial deck you were not given. We may remove such content and close the account behind it if we are told about it and it is plainly unlawful.

nodes plus

nodes plus is a monthly subscription. While it is active you get:

Price and payment. $4.99 a month, with tax already included. You may pay in your own currency at checkout, and your receipt shows the exact amount. You pay through Stripe, which sells the subscription to you as merchant of record. Stripe's own terms, shown at checkout, cover the payment itself.

Renewal and cancelling. The subscription renews automatically every month. To cancel, go to Settings → Account → Manage subscription in the app. You keep nodes plus until the end of the month you have paid for, and nothing more is charged. If a renewal payment fails, you have a short grace period to update your card before nodes plus switches off.

Changes. If we raise the price or remove a feature you are paying for, we will email you at least 30 days before it applies. You can cancel before then and never pay the new price.

Changing your mind: 14 days

If you are a consumer in the EU, you may withdraw from the subscription within 14 days of buying it, without giving a reason. Write to privacy@nodes.cards from the email address on your account, or use any clear statement.

Within 24 hours of buying, if you have not used any AI allowance: we refund the whole payment.

Otherwise, within 14 days: nodes plus starts the moment you pay, because at checkout you ask for it to start straight away. So if you withdraw, you pay for what you already used and get the rest back. What you used is the larger of two shares of the month's price: the share of the month that has passed, or the share of the month's AI allowance you have spent. Spend the whole allowance and nothing is refunded. Withdraw on day 3 having used no AI, and you get back about 90%.

After 14 days there is no refund, but you can always cancel, and nothing more is charged. A refund goes back to the card you paid with, normally within a few days, and nodes plus ends.

Complaints

If something does not work as these terms say, write to privacy@nodes.cards. Say what happened and what you would like done. We reply within 14 days. A problem with a charge, a receipt or a refund can also go to Stripe through the link on your receipt.

If you are a consumer, you may also turn to your local consumer ombudsman. In Poland that is the rzecznik konsumentów of your town or district.

What we promise, and what we cannot

We keep nodes running and your data safe as well as one person reasonably can. We cannot promise it will never be down, never lose a sync, or that the AI will never write a wrong card. Generated cards are a draft: check them before you rely on them for an exam. Keep an export of a collection you could not bear to lose.

Nothing in these terms limits your statutory rights as a consumer, and nothing limits liability for harm caused on purpose or through gross negligence. Beyond that, we are not liable for indirect losses, such as a worse exam result. Our liability for a paid subscription is capped at what you paid for it in the last 12 months.

Ending

You can stop using nodes and delete your account at any time. The privacy page says how and what that deletes. We may suspend or close an account that seriously breaks these terms. If it had a paid subscription, we refund the unused part, unless the reason was fraud. If we ever shut nodes down, we will give at least 30 days' notice, refund any unused paid time, and leave you a way to export your cards.

Law and changes to these terms

Polish law applies. If you are a consumer living elsewhere in the EU, you also keep the protections of your own country's law, and you can go to the courts where you live.

These terms will change with the app. We announce material changes in the app or by email at least 14 days before they apply. Like the privacy page, this page lives in the app's repository, so every edit is a dated commit. The date at the top is the latest one.
